| | | Current State Legislative Proposals | | Wisconsin Abortion Ban
As a result of the April 2007 Gonzalez v. Carhart decision, Senator Scott Fitzgerald and Representative Tony Staskunas are introducing a bill to ban the partial-birth abortion procedure in Wisconsin. The U.S. Supreme Court decision in Gonzalez v. Carhart upheld the federal Partial-Birth Abortion Ban Act of 2003 ruling that a particular procedure in abortion could be outlawed despite significant medical testimony that such procedure is necessary in many instances to preserve the health of the women. This legislation for the State of Wisconsin closely mirrors the language of the federal law, which can be found at 18 USC 1531 of the United States Code. |

 | Repeal of Wisconsin's Criminal Abortion Statute Representative Terese Berceau and Senator Mark Miller are currently circulating the Women’s Healthy & Safety Act, a bill that would repeal Wisconsin’s 1849 criminal abortion statute still on the books. This law is so extreme that it imposes jail time on women who obtain an abortion, even those who are victims of sexual assault or with serious health conditions. |
